Results from a survey based on "Developments in Criminal Law in Europe" by the Max Planck Institute are presented.
Abstract
This survey covers 21 national reports on legislation, reform projects, court cases, and literature in the field of substantive criminal law, subsidiary criminal law, criminal procedure, prison law, human rights, and international law of most of the eastern and western European states. Information in this survey is presented in the following categories: (1) General situation with regard to criminal policy; (2) General principles (general and partial reforms; descriptive elements of crime, prohibition of analogy; causation, objective attribution of consequences; principle of fault, subjective attribution of consequences; justification and excuse; attempt; complicity); (3) System of penalties (death penalty; imprisonment; pecuniary penalties, skimming of profits, confiscation, forfeiture, compensation; conditions of labor imposed as penalties; suspension of sentence, parole; other alternatives and incidental consequences; determination of sentence; system of security and rehabilitative measures). 201 footnotes
