A brief history of worldwide historical and environmental developments and changes previews a more detailed analysis of specific Colombian environmental laws.
Abstract
The review begins in with the Biblical versus the "Big Bang" theories of the evolution of the world, progressing quickly to colonial Spanish times and the present. The current state of disarray is blamed on three specific periods of exploitation during the industrial revolution and the current worldwide population explosion. Colombian law since 1980 has been concerned with environmental legalities in the Penal Code, under crime against natural resources in the section on crime against social and economic order. In 1974, during the revision of the Penal Code, the necessity of specific legal care for Colombia's environmental riches resulted in Articles 268, 269, and 270 of the Colombian Penal Code. In 1978 and 1979, further laws were added to Articles 242 and 247. These articles are detailed, especially with respect to who commits such crimes, legal and scientific definitions, and the legal consequences of particular actions. The genesis of a political-criminal environmental policy and its components are outlined. 32 references
