COMMITTEE RECOMMENDATIONS WHICH WILL TEND TO ACCOMPLISH THE OBJECTIVE OF A 90-DAY APPELLATE DISPOSITION FOR FEDERAL COURT CASES.
Abstract
THE REPORT RECOMMENDS THAT TRIAL TRANSCRIPTS BE MADE AVAILABLE TO THE APPELLATE COURT WITHIN 30 DAYS OF SENTENCE AND THAT THE DECISION TO APPEAL BE MADE WITHIN 10 DAYS OF SENTENCE. THE COMMITTEE ALSO SUGGESTS THAT APPELLANT'S BRIEF BE FILED 30 DAYS AFTER NOTICE OF APPEAL, THAT APPELLEE'S BRIEF BE FILED 30 DAYS THEREAFTER, AND THAT ORAL ARGUMENT BE SCHEDULED A WEEK TO TEN DAYS AFTER THE BRIEFS HAVE BEEN FILED. IN ADDITION, JUDGES SHOULD USE EITHER WRITTEN OR ORAL SUMMARY DECISIONS, IF OPINIONS OF THIS TYPE ARE PERMITTED IN THEIR JURISDICTIONS.
