PROFILE OF 500 FEDERAL OFFENDERS IN THE NORTHERN DISTRICT OF CALIFORNIA, AND COMPARISON OF THOSE INCARCERATED WITH THOSE PLACED ON PROBATION.
Abstract
THIS STUDY EXAMINED THE CHARACTERISTICS OF AGE, RACE, AND SEX, WHICH ARE CORRELATED TO THE OFFENSE COMMITTED, PREVIOUS CRIMINAL ACTIVITY, EMPLOYMENT HISTORY, AND INVOLVEMENT WITH DRUGS AND ALCOHOL. IN COMPARING PROBATION TO IMPRISONMENT, THE AUTHOR FOUND THAT OFFENDERS WHO PLED GUILTY OR WHO RETAINED PRIVATE ATTORNEYS WERE MORE LIKELY THAN THOSE WHO DID NOT TO RECEIVE PROBATION. EMBEZZLEMENT AND FALSE STATEMENTS WERE THE OFFENSES MOST LIKELY TO LEAD TO PROBATION, WHILE BANK ROBBERY AND VIOLATION OF NATIONAL DEFENSE LAWS WOULD PROBABLY LEAD TO IMPRISONMENT. THIS WAS DUE TO PERSONAL CHARACTERISTICS OF THE INDIVIDUAL RATHER THAN TO THE OFFENSE ITSELF. AGE AND RACE WERE FOUND NOT TO BE DECIDING FACTORS. PROBATIONERS AND PRISONERS ARE ALSO COMPARED ON THE BASIS OF ALL OTHER DEMOGRAPHIC DATA PRESENTED IN THE STUDY IN AN ATTEMPT TO FIND WHICH CHARACTERISTICS INFLUENCE THE DETERMINATION OF SENTENCE.
