THE AUTHOR REVIEWS THE STRUCTURE AND ROLE OF THE JUVENILE COURT IN INDIA, AND PROPOSES A SEPARATION OF THE ADJUDICATION AND DISPOSITION FUNCTIONS OF THE JUVENILE COURT.
Abstract
AFTER TRACING THE HISTORICAL DEVELOPMENT OF JUVENILE LAWS AND COURTS BOTH INTERNATIONALLY AND IN INDIA, THE AUTHOR ANALYSES GENERALLY THE MANNER IN WHICH THE LAWS ARE APPLIED IN INDIA. HE POINTS OUT THAT AT PRESENT THE JUVENILE COURT PERFORMS A DUAL ROLE, THAT OF DETERMINING THE GUILT OR INNOCENCE OF THE JUVENILE AND ALSO THAT OF PRESCRIBING A FORM OF TREATMENT FOR THOSE FOUND GUILTY. HE QUESTIONS THE WISDOM OF THIS DUAL ROLE BY THE COURT AND PROPOSES A SEPARATION OF THESE FUNCTIONS. IN CONCLUSION, THE AUTHOR CALLS FOR IMPROVEMENT OF INSTITUTIONAL AND NON-INSTITUTIONAL SERVICES FOR JUVENILES. HE ALSO ADVOCATES THAT INCREASED ATTENTION BE GIVEN TO THE PREDELINQUENT YOUTH...DMC
