TWO MAJOR PRINCIPLES ARE RECOMMENDED: THAT THE ACCUSED SHOULD BE RELEASED UNLESS IT CAN BE ESTABLISHED THAT COURT NONAPPEARANCE IS LIKELY, AND THAT PERSONS SHOULD BE HELD ONLY AFTER A COURT HAS CONSIDERED ALL RELEVANT DATA.
Abstract
THE SERIOUS EFFECTS OF REFUSING BAIL ARE UNDERLINED, AND THE REMANDING OF FIRST OFFENDERS AND YOUNG PEOPLE IS DISCUSSED. SOME ASPECTS OF COURT PROCEDURE ARE THEN EXAMINED: THE CRIMINAL JUSTICE ACT OF 1967 AND THE COURT SITUATION FROM THE POINT OF VIEW OF THE DEFENDANT. VARIOUS FACTORS WHICH AFFECT THE BAIL DECISION AND THE SPECIFIC GROUNDS ON WHICH BAIL MAY LEGITIMATELY BE REFUSED ARE ALSO REVIEWED. AFTER CONSIDERING DIFFICULTIES RELATING TO SURETIES, POSSIBLE SOLUTIONS TO THE PRESENT BAIL SITUATION ARE DISCUSSED. THESE INCLUDE A SCHEME FOR SUPPLYING FULLER INFORMATION TO COURTS AND THE USE OF BAIL HOSTELS. SEVERAL RECOMMENDATIONS ARE PRESENTED IN SUMMARY FORM. (AUTHOR ABSTRACT MODIFIED)
