DEVELOPMENT OF PROBATION SYSTEM IN MICHIGAN FROM ITS INCEPTION IN 1903 UNTIL 1937.
Abstract
IN 1903 THE FIRST PROBATION LAW WAS ENACTED. IT ALLOWED PROBATION ONLY IN CASES OF A FIRST OFFENSE. NO TIME PERIOD OR TERMS WERE STIPULATED AND MUCH WAS LEFT TO THE DISCRETION OF THE JUDGE. IN 1913 A UNIFORM PROBATION LAW WAS PASSED WHICH IS BASICALLY THE LAW NOW IN EFFECT. UNDER THE NEW LAW THE PROBATION PRIVILEGE WAS NO LONGER LIMITED TO THE FIRST OFFENDER. IT ESTABLISHED THE PROBATION OFFICER AS AN OFFICIAL POSITION. IT SET DEFINITE LIMITS ON THE LENGTH OF TIME ONE COULD BE PLACED ON PROBATION, AND ESTABLISHED OPERATING CONDITIONS FOR PROBATIONERS. IN 1937 THE MICHIGAN LEGISLATURE CREATED A STATE DEPARTMENT TO COORDINATE PRISON, PARDON AND PAROLE WORK AND TO SUPERVISE ALL PROBATION FUNCTIONS.
