Three categories of illegal aliens can be expelled from the Netherlands: those who entered illegally, asylum seekers who have exhausted the appeal process, and criminal aliens.
Abstract
Expulsion is seen as a way of limiting the number of aliens and of preventing the use of welfare benefits. To ensure expulsion, aliens can be held in custody. However, the lawfulness, fairness, duration, and effectiveness of custody have been questioned. The authors describe the reality of custody and expulsion. They note that a substantial number of those held in custody are being released when custody is no longer warranted. They conclude that the effectiveness of custody should not be overrated, since custody does not always lead to expulsion and recidivism is frequent. 9 references and 7 notes
