ANALYSIS OF THE IMBALANCE BETWEEN PRETRIAL AND POSTCONVICTION DETENTION IN THE NEW HAVEN JAIL'S REDIRECTION CENTER.
Abstract
TO ASSESS THE MAGNITUDE OF THE PRETRIAL DETENTION PROBLEM, THE RESEARCH TEAM EXAMINED THE RELATIONSHIP BETWEEN THE NUMBER OF PRETRIAL DETAINEES WHO WERE CONVICTED AND INSTITUTIONALIZED AND THE TOTAL OF ALL PRETRIAL DETAINEES. THE DATA STRONGLY SUGGEST THAT THE MAJORITY OF PERSONS INCARCERATED IN CONNECTICUT ARE JAILED ONLY PRIOR TO TRIAL AND THAT JUDGES ARE MORE LIKELY TO RELEASE A DEFENDANT WHO HAS BEEN CONVICTED THAN ONE WHO GOES TO JAIL BECAUSE HE CANNOT RAISE BAIL. THE RESEARCH TEAM THEN EXAMINED THE ACCUSED POPULATION AND THE SENTENCED POPULATION ON A MONTHLY BASIS AND ARRIVED AT A RATIO TO DETERMINE THE IMBALANCE BETWEEN THE TWO GROUPS. THE DATA SUGGEST THAT 70 PERCENT OF ALL PERSONS WHO SPEND TIME IN JAIL PRIOR TO TRIAL SERVE NO TIME IN CUSTODY AFTER CASE DISPOSITION. CONSIDERATION IS THEN GIVEN TO FACTORS WHICH MAY JUSTIFY PRETRIAL DETENTION, SUCH AS AN OFFENDER'S PRIOR RECORD OF BAIL JUMPING, SERIOUSNESS OF THE CRIME, AND CASES IN WHICH SUSPECT IS CURRENTLY ON PROBATION OR PAROLE.
