              This document provides instructions for the implementation of the Indian Pass Through Amendment to the Juvenile Justice and Delinquency Prevention (JJDP) Act, which was amended during the 1988 reauthorization period.
          Abstract
              The amendment requires participating States use a portion of the formula grant provided to local public and private organizations to fund programs of Indian tribes that perform law enforcement functions. To receive funding, the tribes must agree to comply with provisions of the Act requiring the deinstitutionalization of juvenile status offenders and nonoffenders, the separation of juveniles and adult offenders, and the removal of juveniles from adult jails and lockups. These instructions describe the calculation of the Indian pass through amount, the establishment of eligibility for Indian tribes, alternative methods of making funds available to Indian tribes under specific circumstances, and the requirement to consult with Indian tribes in State plan development.
