DISCUSSION OF A CALIF. SUPREME COURT DECISION WHICH LIMITED THE SCOPE OF THE ROUTINE POLICE INVENTORY OF THE CONTENTS OF A CAR BEFORE PLACING IT IN STORAGE.
Abstract
WHILE THE INVENTORY SEARCH IN MOZZETTI V. SUPERIOR COURT OF SACRAMENTO COUNTY, WHICH LED TO THE DISCOVERY OF EVIDENCE IN DEFENDANT'S SUITCASE, WAS HELD TO BE AN UNREASONABLE SEARCH AND SEIZURE IN VIOLATION OF THE FOURTH AMENDMENT, THE DECISION DOES NOT PRECLUDE THE SEIZURE OF ITEMS LOCATED IN PLAIN SIGHT WITHIN AN AUTOMOBILE BEING TAKEN INTO CUSTODY.
