REVIEW OF THE WORK OF NEW YORK CITY'S JEWISH CONCILIATION BOARD OF AMERICA, AN ARBRITRATION BOARD WHICH PROVIDES A FORUM FOR RELIGIOUS, FAMILY, AND BUSINESS DISPUTES.
Abstract
THE BOARD CAN ONLY ASSUME JURISDICTION WHEN BOTH PARTIES SUBMIT THEMSELVES TO ITS AUTHORITY. THEY APPEAR BEFORE A THREE-PERSON ADJUDICATORY BODY CONSISTING OF A RABBI, A BUSINESSMAN AND AN ATTORNEY. THE PANEL IS ASSISTED BY A RESIDENT PSYCHIATRIST. IF BOTH PARTIES DO NO APPEAR, THE BOARD LISTENS TO THE SIDE PRESENTED AND MAKES SUGGESTIONS. IN DISPUTES RELATED TO PROPERTY, MONEY OWED AND THE LIKE, THE PARTIES ARE REQUIRED TO SIGN AN ARBITRATION AGREEMENT PRIOR TO THE HEARING. IN THESE CASES, THE BOARD'S DECREE IS FINAL AND FULLY ENFORCEABLE IN A COURT OF LAW. CASES INVOLVING FAMILIAL RELATIONSHIPS, MARITAL DISPUTES AND INTERPERSONAL MATTERS ARE USUALLY DEALT WITH WITHOUT SIGNED ARBITRATION AGREEMENTS. (AUTHOR ABSTRACT)
