THIS REPORT DESCRIBES THE ADMINISTRATION OF JUVENILE JUSTICE IN ARIZONA, EXAMINES THE RELATIONSHIP BETWEEN THEORY AND REALITY, AND MAKES RECOMMENDATIONS FOR IMPROVEMENT.
Abstract
THE EMPIRICAL RESEARCH IN MOST SECTIONS OF THE STUDY WAS LIMITED TO THREE OF THE STATE'S 14 COUNTIES - MARICOPA, PIMA, AND COCHISE. THIS STUDY BEGINS WITH AN EXAMINATION OF LAW ENFORCEMENT ACTIVITIES AS THEY AFFECT JUVENILES, DESCRIBES INTAKE AND DETENTION PROCEDURES OF THE JUVENILE COURT, DISCUSSES THE CONCEPT OF JUVENILE COURT JURISDICTION, AS WELL AS ADJUDICATION, AND CONCLUDES WITH DISCUSSIONS OF APPEALS, PROBATION, AND CORRECTIONS. THE EFFECTIVENESS OF THE IMPLEMENTATION OF THE ENTIRE BODY OF JUVENILE LAW IS THEN EXAMINED FROM CONSTITUTIONAL DECISIONS THROUGH STATE LAW AND LOCAL PROCEDURE. AN ANALYSIS OF THE DOCTRINAL AND FUNCTIONAL EFFICACY OF THE COURT SYSTEMS IS FOLLOWED BY RECOMMENDATIONS FOR IMPROVEMENT DRAWN FROM THE GROWING BODY OF JUVENILE CASE LAW, EXPERIENCES IN ARIZONA AND OTHER JURISDICTIONS, THE NUMEROUS MODEL JUVENILE CODES, AND OTHER SOURCES. APPENDED MATERIALS INCLUDE A BRIEF EXPLANATION OF THE STRUCTURE OF THE JUVENILE COURT AND CENTER IN PIMA COUNTY AND SAMPLES OF THE JUVENILE INTAKE SCREENING FORM AND THE JUVENILE PROBATION AGREEMENT.
