A BRIEF EXAMINATION OF THE GOALS OF THE LAW ENFORCEMENT ASSISTANCE ACT AND A DISCUSSION OF COURT DECISIONS IN ARREST AND SEARCH AND SEIZURE.
Abstract
THE AUTHOR SUGGESTS THAT THE COURTS HAVE BEEN ACTIVE ONLY BY DEFAULT. IN THE ABSENCE OF STATUTORY GUIDELINES, RECOURSE FOR A SPECIFIC INJUSTICE IS TO THE COURTS. ONCE THAT RECOURSE IS TAKEN, THE COURT'S DECISION IS BROADLY READ AND NOT LIGHTLY ALTERED. THE REMEDY MUST BE BY LEGISLATIVE ACTION DEVISING A SET OF COHERENT RULES FOR ARRESTS, INTERROGATION, EAVESDROPPING, AND SEARCH AND SEIZURE.
