Abstract
THIS BOOK IS DESIGNED TO PREPARE OFFICERS FOR THE DAILY EXPERIENCES WHICH MANY OF THEM ENCOUNTER WHEN THEY ARE REQUIRED TO TESTIFY FOR THE PROSECUTION IN THE TRIAL OF A CRIMINAL ACTION. IT WILL ASSIST STATE, CITY, AND COUNTY LAW ENFORCEMENT PERSONNEL IN UNDERSTANDING THE MYSTIFYING TECHNIQUES THAT ONE SEES AND HEARS IN THE COURTROOM. SPECIFICALLY, IT IS NOT INTENDED TO EXPLAIN STEP BY STEP PROCEDURE IN THE GATHERING AND PRESERVATION OF EVIDENCE. THE MAJOR GOAL OF THIS TEXT IS TO MAKE LAW ENFORCEMENT OFFICERS AWARE OF THE TYPES OF EVIDENCE ADMISSIBLE IN A CRIMINAL TRIAL AND VARIOUS METHODS OF PRESENTATION. ARMED WITH THIS KNOWLEDGE, IT IS PRESUMED THAT AN OFFICER WILL BE IN A BETTER POSITION TO MAKE VALID ARRESTS LEADING TO CONVICTIONS. INCLUDED ARE CHAPTERS PRESENTING EXAMINATION OF WITNESSES AND TRIAL PROCEDURES, OPINION EVIDENCE, THE 'BEST EVIDENCE' RULE, THE HEARSAY RULE AND ITS NUMEROUS EXCEPTIONS, PRIVILEGED COMMUNICATIONS, DECLARATIONS AGAINST INTEREST, PRESUMPTIONS, JUDICIAL NOTICE, AND ILLEGALLY OBTAINED EVIDENCE. JUDICIAL DECISIONS RELATING TO THESE CONCEPTS ARE OFFERED IN THE SECOND PART OF THE BOOK. ALSO INCLUDED AS A SEPARATE DOCUMENT IS AN INSTRUCTOR'S MANUAL DESIGNED TO AID INSTRUCTORS IN ORGANIZING LECTURES, PRESENTING MATERIALS, AND TESTING STUDENTS ON THE CONTENT OF THE COURSE.
