GUIDELINES FOR DEFENSE ATTORNEYS IN ADVISING CLIENTS OF THEIR RIGHTS AND PRIVILEGES AT GRAND JURY INVESTIGATIONS.
Abstract
RELEVANT CASE LAW IS EXAMINED, AND SPECIFIC RECOMMENDATIONS ARE OFFERED FOR PRESERVING THE RIGHTS OF WITNESSES AT DIFFERENT STAGES IN GRAND JURY PROCEEDINGS. THE FOLLOWING ISSUES ARE TREATED IN DETAILTHE FIFTH AMENDMENT PRIVILEGE AGAINST SELF-INCRIMINATION, COMPELLED TESTIMONY AND GRANTS OF IMMUNITY, STATE AND FEDERAL IMMUNITY LAWS, USE V. TRANSACTIONAL IMMUNITY, THE RIGHT TO CONFER WITH COUNSEL, JUDICIAL INTERVENTION IN THE PROCEEDINGS, AND DEFENSES AGAINST INDICTMENT FOR CONTEMPT.
