ANALYSIS OF CONJUGAL VISITATION AS IT HAS COME BEFORE THE COURTS AND REVIEW OF THE SYSTEM AS IT IS ACTUALLY PRACTICED, ANALYZING POSITIVE FEATURES AS WELL AS THE REASONS FOR PROHIBITING SUCH PROGRAMS.
Abstract
THE DISCUSSION OF JUDICIAL DECISIONS FOCUSES ON THE ISSUE OF WHETHER OR NOT CONJUGAL VISITATION IS A LEGAL RIGHT. THE COURTS HAVE REPEATEDLY REFUSED TO SO RECOGNIZE IT AND THE FIRST PART OF THIS PAPER EVALUATES THE REASONS THEREFORE. A CASE IS STATED FOR THE IMPLEMENTATION OF SUCH PROGRAMS IN OUR NATION'S PRISONS. THE RESULT OF SUCH ACTION WOULD BE TO RECOGNIZE BASIC HUMAN NEEDS. PROVIDE FOR THEIR CONSTRUCTIVE OUTLET IN AN ATMOSPHERE OF UNDERSTANDING, AND THEREBY BLUNT TO SOME DEGREE THE HARSHNESS OF PRISON LIFE. (AUTHOR ABSTRACT)
