DISCUSSES CASES AND LAWS REGARDING THE ACCURACY AND PROPER USE OF DIFFERENT TYPES OF SPEED MEASUREMENT DEVICES, AND THE ADMISSIBILITY OF EVIDENCE OBTAINED FROM THEIR USE.
Abstract
THE DEVELOPMENT (LEGAL AS WELL AS MECHANICAL) OF THE PHOTO-SPEED RECORDER, SPEEDOMETER, SPEEDWATCH, PHOTO-TRAFFIC CAMERA, FOTO-PATROL, TACHOGRAPH, AND RADAR IS PRESENTED. THE LEGALITY OF RADAR DETECTION AND JAMMING DEVICES IS DISCUSSED. OTHER TOPICS INCLUDE THE USE OF SCIENTIFIC EVIDENCE IN LAW ENFORCEMENT, THE ADMISSIBILITY AND EFFECT OF SCIENTIFIC EVIDENCE, THE CONSTITUTIONAL ASPECTS OF SPEED-MEASUREMENT DEVICES, THE EFFECT OF CERTAIN STATUTORY PROVISIONS (INCLUDING SOME RELATING TO SPEED-TRAPS) AND SPEED DETECTION BY AIRCRAFT. THE APPENDIX INCLUDES A SUGGESTED LIST OF QUESTIONS TO BE USED IN QUALIFYING A RADAR OPERATOR FOR GIVING TESTIMONY IN COURT.
