GENERAL ADMISSIBILITY REQUIREMENT FOR SCIENTIFIC IDENTITY TESTS, POSSIBLE CONSTITUTIONAL LIMITATIONS, CASES DEALING WITH VOICEPRINT IDENTIFICATION AS EVIDENCE.
Abstract
THE TEST USED FOR LEGAL ACCEPTABILITY OF A NEW SCIENTIFIC PROCESS IS THE SCIENTIFIC DETERMINATION OF VALIDITY AND RELIABILITY. THE CONSTITUTIONAL REQUIREMENTS OF THE FOURTH, FIFTH, AND SIXTH AMENDMENTS PRESENT NO DIFFICULTIES FOR VOICEPRINT IDENTIFICATION. THE CASES INDICATE THAT VOICEPRINT IDENTIFICATION FAILS TO MEET THE ADMISSIBILITY REQUIREMENT FOR IDENTITY TESTS. THE MAJOR OBSTACLE LIMITING ITS USE IS THE LACK OF GENERAL SCIENTIFIC ACCEPTANCE.
