These essays focus on the consequences of court involvement in education and the impact of judicial rulings on disciplinary procedures in the public schools.
Abstract
One essay discusses overextension of due process rights of juveniles in schools. Two relatively recent developments have combined to multiply the application of the due process clause to cases arising out of the administration of the public school system. These developments include the invocation of the fourteenth amendment to protect 'liberty interests' and 'property rights,' and the extension of the amendment's protection to trivial and inconsequential decisions of local boards of education. Topics addressed in remaining essays include probable new directions concerning discipline and the handicapped, the unintended consequences some recent cases have had on schools and the educational process, codes of student conduct, and school-police relations regarding the criminal prosecution of students. Two essays review and analyze the individual court cases forming the basis of current law on school personnel actions. Reference notes are provided.
