A DESCRIPTION OF THE REVISED SWISS LAWS DEALING WITH CHILDREN, ADOLESCENTS, AND YOUNG ADULTS, WHICH STRESS TREATMENT IN THE COMMUNITY AND IN A PROTECTED ENVIRONMENT.
Abstract
IN SWITZERLAND, DELINQUENT CHILDREN ARE DEALT WITH ACCORDING TO THE PENAL CODE, BUT THEIR TREATMENT IS MORE INFLUENCED BY THE BEHAVIORAL SCIENCES THAN BY THE TENETS OF THE CLASSICAL PENAL LAW. THE CODE DISTINGUISHES FOUR GROUPS OF MINORS ACCORDING TO AGE - CHILDREN UNDER 7 YEARS OF AGE, CHILDREN BETWEEN THE AGES OF 7 AND 15, ADOLESCENTS BETWEEN 15 AND 18, AND YOUNG ADULTS BETWEEN EIGHTEEN AND TWENTY-FIVE. CHILDREN AND ADOLESCENTS ARE EXEMPTED FROM THE PUNISHMENTS FOR ADULTS, BUT ADOLESCENTS CAN BE FINED. SANCTIONS FOR MINORS CONSIST OF EDUCATIONAL MEASURES, SPECIAL TREATMENT, DISCIPLINARY PUNISHMENTS, AND PENAL SANCTIONS FOR ADOLESCENTS. YOUNG ADULTS ARE DEALT WITH BY THE ADULT COURT, BUT THE LATTER IS ADVISED TO APPLY SOME PRINCIPLES OF THE JUVENILE CODE. COURT INQUIRY PROCEDURES, AND CHARACTERISTIC MEASURES OF THE SWISS JUVENILE CODE SUCH AS SPECIAL TREATMENT OR REHABILITATION THROUGH THE ASSIGNMENT OF WORK TASKS ARE DESCRIBED.
