DISCUSSION OF PROBLEMS INVOLVED IN THE ENFORCEMENT OF ITALIAN DRUG TRAFFIC AND DRUG ABUSE LAWS, WITH SPECIAL ATTENTION TO THE ALLEGED RIGHT OF AN INDIVIDUAL TO THE POSSESSION OF NARCOTICS FOR HIS OWN USE.
Abstract
NEW NARCOTIC SUBSTANCES, INCLUDING ARTIFICIAL ONES, COME INTO USE FROM TIME TO TIME. ITALIAN LAW IS AMBIGUOUS IN REGARD TO DEALING WITH THEM. THE IDEA OF GOING AFTER THE DISTRIBUTORS RATHER THAN THE USERS OF DRUGS IS PERHAPS MORALLY ADMIRABLE, BUT IT CANNOT BE APPLIED IN PRACTICE BECAUSE NEARLY ALL PUSHERS ARE ALSO USERS. AFTER PRESENTING ARGUMENTS ON BOTH SIDES, THE AUTHOR CONCLUDES THAT THE ONLY WAY A PERSON CAN HAVE ANY AMOUNT OF NARCOTICS IN HIS POSSESSION LEGALLY IS THROUGH A DOCTOR'S PRESCRIPTION OR OFFICIAL PERMISSION FROM THE MINISTRY OF HEALTH. --IN ITALIAN
