WEST GERMAN CRIMINAL LAW REFORMS ARE VIEWED IN THE CONTEXT OF THE WORLDWIDE MOVEMENT FOR THE MODERNIZATION, LIBERALIZATION, AND HUMANIZATION OF CRIMINAL LAW WHICH BEGAN AT THE END OF THE 1950S.
Abstract
GERMAN CRIMINAL LAW REFORM WAS BROUGHT TO A PRELIMINARY CONCLUSION ON THE 1ST OF JANUARY 1975 WITH THE COMING INTO FORCE OF A REVISION OF THE PENAL CODE OF 1871 WHICH WAS STILL BASED ON THE INTELLECTUAL CLIMATE OF THE FIRST OF THE NINETEENTH CENTURY. IMPORTANT REFORMS INLCUDE DECRIMINALIZATION, REFORM OF IMPRISONMENT, AND REFORM OF THE SYSTEM OF FINES. DISCUSSED IS THE INFLUENCE OF GERMAN CRIMINAL LAW ON THAT IN OTHER COUNTRIES.
