Fire department arson investigators should have peace officer status to broaden their ability to combat arson.
Abstract
The authors researched pertinent literature and spoke with fire and police officials to determine the advantages and disadvantages of peace officer status for fire department arson investigators. The fire service should not subordinate itself by shifting arson cases to the police department voluntarily. Peace officer status provides the investigators the law enforcement training necessary to handle querulous suspects, to arrest, to determine fire cause, and to understand applicable law. Arson investigators must be trained in the use of firearms and should carry arms to protect themselves. The closer affiliation with the police allows for open communication and encourages information sharing. However, since arson investigation has traditionally been either with the fire department or with the police department, this blurring of lines of authority can cause territorial battles, professional jealousy, and confusion about roles. Municipalities employing this method for investigation find it to be a successful means of combating arson. Twelve notes and 10 references are provided.
