After an introduction that describes the history, structure, and content of the Romanian Penal Code, this book presents an English translation of the code.
Abstract
The current code, effective on January 1, 1969, is divided into a General Part and Special Part. The General Part has eight Titles that cover the preliminary provisions as well as provisions related to the limits on the application of the penal law with regard to space and time. It addresses the offenses, the penalties (principal, additional, and accessory), replacement and waiver of penal liability, minority, and security measures. A glossary is also included. The Special Part contains the Titles, Chapters, and Sections that deal with specific offenses committed against the State, the person, personal or private property, social property, authority, the activity of State organizations, economic activities, social life, the defense capacity of the State, and peace and mankind. Also covered are offenses related to various kinds of falsification. Overall, the penal law is designed to protect the State, either by preventing or by punishing acts that have an antisocial or "socially dangerous" character. Offenses against social property are considered equal to those against State security.
