REVIEW OF RECENT COURT DECISIONS IN FRANCE REGARDING LEGAL LIMITATIONS ON POLICE IN CARRYING OUT PERSONAL SEARCHES AND IDENTITY CHECKS, ESPECIALLY WHEN THEY INVOLVE THE ARREST OR DETENTION OF THE SUSPECT.
Abstract
DISCUSSED ARE DISTINCTIONS DRAWN BETWEEN THE TWO TYPES OF POLICE ACTION AND BETWEEN THE POLICE POWERS OF THE TWO TYPES OF POLICE IN FRANCE, THE ADMINISTRATIVE AND THE CRIMINAL POLICE. THE COURTS STIPULATE THAT PERSONAL SEARCH, DETENTION, OR ARREST MUST BE JUSTIFIED BY THE REASONABLE SUSPICION THAT THE SUSPECT HAS COMMITTED AN OFFENSE. --IN FRENCH
