THIS SURVEY OF POLICE CONTRACTS IN 98 CITIES WITH POPULATIONS OF MORE THAN 100,000 PROVIDES REFERENCE INFORMATION ON POLICE COLLECTIVE BARGAINING FOR CITY OFFICIALS AND POLICE ADMINISTRATORS.
Abstract
THIS REFERENCE TOOL IS DESIGNED TO HELP CITY MANAGEMENT NEGOTIATORS APPROACH BARGAINING SESSIONS WITH A LIST OF THEIR OWN GOALS, RATHER THAN LIMITING THEIR NEGOTIATING STRATEGY TO HOLDING DOWN CONCESSIONS TO POLICE UNIONS. THE SURVEY REPORT PROVIDES EXAMPLES OF CONTRACT LANGUAGE FOR MANY DIFFERENT AGREEMENTS AND AN ANALYSIS OF THE IMPLICATIONS OF MANAGEMENT DECISIONMAKING FOR 15 COMMON CONTRACT CLAUSES. ACCOMPANYING CHARTS LISTING SURVEYED CITIES AND COMMENTARY NOTE NATIONAL TRENDS OF UNION DEMANDS AND MANAGEMENT PRACTICES. THE FOLLOWING ISSUES ARE ADDRESSED: (1) MANAGEMENT RIGHTS CLAUSES, (2) GRIEVANCE AND ARBITRATION PROCEDURES, (3) DISCIPLINE AND POLICE OFFICER BILL OF RIGHTS, (4) COST OF LIVING ADJUSTMENT CLAUSES, (5) CIVIL SERVICE AND THIRD PARTY ENTITIES, (6) SENIORITY, (7) TRANSFERS, (8) REDUCTION IN FORCE, (9) SICK LEAVE, (10) RULES AND REGULATIONS, (11) TRAINING AND EDUCATION, (12) SUBCONTRACTING, (13) MAINTENANCE OF STANDARDS, (14) NO STRIKE CLAUSES, AND (15) ZIPPER CLAUSES I.E., PROVIDING THAT THE CONTRACT IS THE ONLY AND TOTAL AGREEMENT. THE APPENDIXES CONTAIN AN INDEX TO POLICE AND FIRE ARBITRATION CASES THROUGH FALL 1977 AND A COMPREHENSIVE CHART SHOWING THE COLLECTIVE BARGAINING AGREEMENTS IN EACH OF THE CITIES INCLUDED IN THE SURVEY.
