THE IMPACT OF SUPREME COURT DECISIONS FROM 1961 TO 1969 ON LAW ENFORCEMENT AGENCIES.
Abstract
CONSIDERATION IS GIVEN TO PROCEDURAL AREAS OF IMMEDIATE POLICE CONCERN - SEARCH AND SEIZURE, THE EXCLUSIONARY RULE, WIRETAPPING, RIGHT TO PRESENCE OF COUNSEL AT CRITICAL STAGES, ON-STREET DETENTION AND QUESTIONING, ARREST, UNDELAYED ARRAIGNMENT, ADMISSIBILITY OF CONFESSIONS AND THE FIFTH AMENDMENT. THE POLICE FINDS A CORRELATION BETWEEN THESE DECISIONS AND THE RISE IN CRIME, AND THAT SINCE SOCIOLOGY, PSYCHOLOGY AND PSYCHIATRY HAVE FAILED TO COME UP WITH THE ANSWERS. SOCIETY'S REPLY TO THE FORCES OF CRIME AND VIOLENCE MUST BE THE APPLICATION OF FORCE IN MORE THAN DECISIVE AMOUNTS IN TERMS OF A STRONG, ABLE AND PROFESSIONALLY TRAINED POLICE CONTINGENT, WELL SUPPORTED BY THE COURTS AND THE PEOPLE THEY SERVE.
