This report describes the final quarter of the San Jose (California) Police Department's legal advisor program -- April through July 1971 -- and includes its monthly publications on court decisions affecting police procedures and problems encountered by police in applying State and Federal codes.
Abstract
An overview of the police legal advisor's activities during the 1-year period his salary was funded by an LEAA discretionary grant emphasizes that demand for the lawyer's services extended across a wide range of police services and made classification for statistical purposes difficult. In the beginning of the grant year, a large proportion of time was spent on administrative details, but time allotted to training increased substantially as the program progressed. San Jose has indicated its willingness to support the legal advisor program by allocating funds for the salary in its 1971-1972 budget. This report includes a sample of the attorney's daily activity report, a summary of the types of legal services he performed during the last quarter, and a comparison of these figures with the first quarter. Copies of the training publication called 'Parade of Decisions' are appended and cover court decisions on search and seizure, line-ups, probation, rules of evidence, and other procedural topics. Copies of a monthly law training bulletin are also provided which discuss Federal firearms violations, vehicle code citations, and model Rules of Court on Police Action from Arrest to Arraignment prepared by the Council of Judges of the National Council on Crime and Delinquency.
