This paper provided amended proposals and contributions, under agenda item four, received by the United Nations from various governments on the revised draft protocol against the illegal trafficking in and transporting of migrants.
Abstract
The paper provided amended proposals to 16 articles of the revised draft Protocol (legal procedure) against the smuggling of migrants by land, air, and sea. This legal instrument supplements the United Nations Convention Against Transnational Organized Crime. The amended proposals were submitted from Azerbaijan, for the following articles: Article 1- Relation to the United Nations Convention Against Transnational Organized Crime; Article 2- Definitions; Article 3- The Criminal Liability of Migrants; Article 4- Criminalization; Article 5- Scope of Application; Article 6- Jurisdiction; Article 7a- Measures Against the Smuggling of Migrants by Sea; Article 7b- Safeguard Clauses; Article 7c- Measures for the Protection of Immigrants; Article 8- Compliance Measures and Arrangements; Article 9- Other Legislative and Administrative Measures Against Smuggling of Migrants by Land, Air, or Sea; Article 10- Information; Article 11-Prevention; Article 12- Security and Control of Documents; Article 14- Training; Article 15- Return of Smuggled Migrants; and Article 16- Implementation.
