Abstract
LEARNING BY EXPERIENCE ALONE IS AN EFFECTIVE BUT TIMECONSUMING ENDEAVOR FOR NEWLY APPOINTED OR ELECTED PROSECUTORS. THE TECHNIQUES OF PRETRIAL AND MOTIONS PRACTICE, TRIAL TACTICS, AND POST CONVICTION PROCEDURES ARE THE SUBJECT OF THIS COLLECTION OF ARTICLES BY EXPERIENCED PROSECUTORS. A SECTION ON PRETRIAL PROCEEDINGS AND MOTIONS PRACTICE HAS SELECTIONS ON INTERVIEWING THE COMPLAINING WITNESS, PLEA BARGAINING, AND CRIMINAL DISCOVERY. THREE ARTICLES DEAL SPECIFICALLY WITH ASPECTS OF WORKING WITH THE GRAND JURY. TRIALS ARE DISCUSSED IN TWO SECTIONS. IN THE FIRST OF THESE, ATTENTION IS DIRECTED TO SPECIAL PROBLEMS OF SUBSTANTIVE OFFENSES, SUCH AS THE CONCEPT OF 'ENTRY' UNDER BURGLARY STATUTES AND PROOF OF VALUE IN THEFT CASES. THE SECOND TRIAL SECTION CONCENTRATES ON PROCEDURE, EVIDENCE, AND DEFENSES. EACH ASPECT OF THE TRIAL PROCESS, FROM SELECTING A JURY THROUGH PRESENTING AN EFFECTIVE CLOSING ARGUMENT, IS DISCUSSED FROM A PRACTICAL VIEWPOINT. EVIDENTIARY ISSUES FREQUENTLY ENCOUNTERED DURING CRIMINAL TRIALS ARE DISCUSSED AND SEVERAL WAYS TO MEET AN INSANITY DEFENSE ARE NOTED. THE FINAL TWO SECTIONS TREAT POSTTRIAL PROCEDURES, JUVENILE DELINQUENCY, AND THE SPECIAL PROBLEMS INVOLVED WITH THE UNIFORM RECIPROCAL ENFORCEMENT OF SUPPORT ACT. BOTH VETERAN AND NEOPHYTE PROSECUTORS WILL FIND MUCH PRACTICAL INFORMATION IN THIS COMPREHENSIVE WORK AND MEMBERS OF THE GENERAL PUBLIC WILL GAIN NEW INSIGHT INTO THE PROSECUTOR'S FUNCTIONS.
