DISCUSSION OF SENTENCING AS A LEGAL SERVICE FOR THE PROTECTION OF SOCIETY.
Abstract
THE AUTHOR OUTLINES VARIOUS DIFFICULTIES AND ABUSES WHICH HE HAS OBSERVED IN THE CANADIAN SYSTEM. HE ADVOCATES A RADICAL CHANGE IN BOTH SENTENCING AND ITS APPLICATION. HE SUGGESTS THAT IN THIS WAY MUCH LESS EMPHASIS WOULD BE PLACED ON REHABILITATION THROUGH FORMAL PSYCHOTHERAPY OR COUNSELING. INSTEAD, THERE WOULD BE MORE EMPHASIS ON WAYS TO COMPENSATE SOCIETY FOR THE HARM CAUSED BY THE INDIVIDUAL. THE AUTHOR RECOMMENDS THAT THIS COMPENSATION TAKE PLACE WITHOUT INCARCERATING THE OFFENDER, AND THAT PRISON TERMS BE RESERVED FOR 'UNSTABLE, UNWILLING OR DANGEROUS PEOPLE'.
