PROCEDURES TO RESOLVE DETAINERS, WHICH ARE NOTICES OF IMPENDING CRIMINAL CHARGES AGAINST A PRISONER IN ANOTHER JURISDICTION, THROUGH THE RIGHT TO A SPEEDY TRIAL.
Abstract
THE DETAILS OF THE PROVISIONS IN THE INTERSTATE AGREEMENT ON DETAINERS ARE EXPLAINED. THIS LAW ALLOWS INMATES IN ALL FEDERAL AND SOME STATE PRISONS TO REQUEST, BY LETTER, A FINAL DISPOSITION OF THE CHARGES PLACED AGAINST THEM BY DETAINER. REMEDIES AVAILABLE TO INMATES IN THOSE STATES WHICH HAVE NOT ADOPTED THE INTERSTATE AGREEMENT ARE OUTLINED. THESE SOLUTIONS ARE BASED UPON SEVERAL COURT DECISIONS ON THE RIGHT TO A SPEEDY TRIAL. FORMS ARE PROVIDED TO SERVE AS MODELS FOR LETTERS AND MOTIONS UNDER THE INTERSTATE AGREEMENT AND THE OTHER ACTIONS.
