Abstract
AS CRIME HAS GROWN IN VOLUME AND COMMUNICATIONS HAVE BECOME MORE RAPID AND PERVASIVE, THE NECESSITY OF ESTABLISHING PROCEDURES AMENABLE TO THE REQUIREMENTS BOTH OF FREE PRESS AND FAIR TRIAL HAS BECOME MORE COMPELLING. PRESENTED ARE ABA RECOMMENDED STANDARDS, WHICH ATTEMPT TO ACCOMMODATE BOTH THE REQUIREMENTS OF A FREE PRESS AND A FAIR TRIAL. THE STANDARDS ARE DIRECTED PRIMARILY TO LAWYERS, COURT, AND LAW ENFORCEMENT PERSONNEL, AND NOT TO THE PRESS. THE INTENT IS TO CLARIFY THE TYPES OF INFORMATION WHICH MAY BE PREJUDICIAL AND WHICH SHOULD BE RELEASED PROMPTLY. THE STANDARDS RELATE TO THE CONDUCT OF ATTORNEYS, TO THE CONDUCT OF LAW ENFORCEMENT OFFICERS, AND TO THE CONDUCT OF JUDICIAL PROCEEDINGS. THE FULL TEXT OF THE STANDARDS IS PRESENTED IN APPENDIX A.
