THIS IS A DOCTORAL THESIS ON THE INTERPRETATION, ADMINISTRATION, AND EXPERIENCES OF APPLYING PENAL GUARDIANSHIP TO MULTIPLE RECIDIVISTS IN FRANCE.
Abstract
PENAL GUARDIANSHIP TO MULTIPLE RECIDIVISTS IN FRANCE. ON THE DECISION OF THE COURT, MAY BE SENTENCED TO AN EXTENDED SPECIAL SENTENCE OF 10 YEARS ON COMPLETION OF THEIR REGULAR SENTENCE. THE PURPOSE OF THE LEGISLATION, PASSED IN 1970, IS BOTH TO PROVIDE INCREASED PROTECTION TO SOCIETY AGAINST CRIMINAL REPEATERS AND TO ALLOW THE PRISON AUTHORITIES A LONGER PERIOD OF TIME IN WHICH TO REHABILITATE THE MULTIPLE OFFENDER. ON COMPLETION OF THE REGULAR SENTENCE, INMATES PUT UNDER THE PROVISIONS OF LEGAL GUARDIANSHIP ARE MOVED TO ANOTHER INSTITUTION FOR OBSERVATION AND EVALUATION. THEY MAY THEN BE GRANTED SEMI-LIBERTY WHICH PERMITS THEM TO LEAVE THE INSTITUTION DURING THE DAY FOR EMPLOYMENT. IF THEIR PERFORMANCE IS SATISFACTORY, THEY MAY THEN BE GRANTED CONDITIONAL FREEDOM WHICH PERMITS THEM TO LIVE OUTSIDE THE INSTITUTION, BUT IMPOSES REPORTING & OTHER REQUIREMENTS ON THEM. THE AUTHOR ALSO DESCRIBES THE OPERATION OF A NUMBER OF INSTITUTIONS IN DIFFERENT PHASES OF PENAL GUARDIANSHIP, AS WELL AS SOME INDIVIDUAL CASES.
