MEMORANDUM OF POLICY AND PRACTICE SETTING FORTH THE POSITION THAT THE PROSECUTOR'S PROPER ROLE IS MINIMAL AND SHOULD, IN GENERAL, BE LIMITED TO A STATEMENT OF FACTS CONCERNING THE DEFENDANT.
Abstract
THE MANHATTAN DISTRICT ATTORNEY BASES HIS POSITION ON THE ABA MINIMUM STANDARDS. HIS ASSISTANTS ARE INSTRUCTED TO LIMIT THEIR PARTICIPATION IN THE SENTENCING PROCESS IN RECOGNITION THAT SENTENCING IS THE RESPONSIBILITY OF THE JUDICIARY. PROVISION IS MADE FOR CONSULTATION WITH THE APPROPRIATE SUPERIORS FOR PERMISSION TO DEVIATE FROM THIS POLICY.
