A FEDERAL JUDGE COMMENTS ON FACTORS WHICH INFLUENCE SENTENCING DECISIONS.
Abstract
THE PROBLEM OF DISPARITY IN SENTENCING DIFFERENT OFFENDERS FOR THE SAME CRIME IS ANALYZED. THERE IS AN EXPLANATION OF THE FEDERAL PROCEDURE FOR IDENTIFYING THE DANGEROUS OFFENDER. AN INVENTORY OF FEDERAL INSTITUTIONAL AND COMMUNITY BASED PROGRAMS FOR TREATMENT IS PROVIDED. GUIDELINES ARE OFFERED FOR DETERMINING LENGTH OF SENTENCE, IMPOSING SENTENCES TO DETER OTHERS, SUSPENDING THE EXECUTION OF A SENTENCE, AND USING MEDICAL AND PSYCHIATRIC REPORTS IN SENTENCING DECISIONS.
