After an introduction that outlines the history, organization, and contents of the Swedish Code of Judicial Procedures, this book presents an English translation of the code.
Abstract
The code, which took effect January 1, 1948, has seven principal divisions. The first defines the composition and organization of the judiciary, and the remaining six address procedural matters. General regulations applicable to proceedings at every level compose the second division. Rules of evidence are compiled in the third, and the three subsequent divisions specify respectively the rules of procedure applicable in the lower courts, the courts of appeals, and the Supreme Court. The final division contains regulations that govern relief from judgments and orders when ordinary legal remedies are time-barred. Each of the principal divisions contains provisions applicable to both civil and criminal proceedings as well as provisions applicable exclusively to one or the other. The special rules applicable to each of the two categories of litigation are assembled in separate subdivisions only in the second and fourth main divisions. Consistency with domestic traditions and usages has been a characteristic feature of Swedish procedural development.
