DISCUSSION OF THE CONCEPTS OF PUBLIC DEFENDER AND COURT APPOINTED COUNSEL AND CRITIQUE OF THE PROVISIONS FOR THEM IN THE CODES OF CRIMINAL PROCEDURE OF THE SWISS CANTONS.
Abstract
THE ARTICLE EXAMINES THE FACTORS IN A CASE WHICH DETERMINE THE OPTIONAL OR REQUIRED USE OF PUBLICLY FUNDED DEFENSE SERVICES. THESE FACTORS INCLUDE THE NATURE OF THE CRIME, PROJECTED LENGTH OF DETENTION OF THE ACCUSED, COMPLEXITY OF THE CASE, AND SUCH CHARACTERISTICS OF THE ACCUSED AS JUVENILE STATUS OR FINANCIAL NEED. THE PROVISIONS VARY SIGNIFICANTLY AMONG THE CODES OF THE VARIOUS JURISDICTIONS. THE AUTHOR OFFERS A LIST OF FIVE CIRCUMSTANCES IN WHICH TO PROVIDE DEFENSE SERVICES IN CASES PUNISHABLE BY INCARCERATION. --IN GERMAN
