This article presents reflections on the typical legal order in the Netherlands, according to which offenders who cannot be held responsible for their acting-out behavior are detained in a forensic psychiatric hospital.
Abstract
This order differs in essentially ways from the prison sentence because of its different goals. The analysis is intended to confront legal opinions about this approach with clinical and therapeutic opinions, which are based on experience with the treatment of seriously disturbed offenders. 24 references
