SEVENTEEN RECOMMENDATIONS FOR REFORM OF PRETRIAL PROCEDURES.
Abstract
ALL THESE RECOMMENDATIONS ARE BASED ON THE AMERICAN FRIENDS SERVICE COMMITTEE'S BELIEF THAT THE LAW SHOULD FAVOR THE RELEASE OF AN ACCUSED, RATHER THAN HIS DETENTION IN JAIL. PROPOSED IS THE USE OF CITATIONS AND SUMMONS INSTEAD OF ARRESTS OR ARREST WARRANTS. THE AMERICAN FRIENDS SERVICE COMMITTEE (AFSC) ALSO FAVORS THE USE OF RELEASE ON RECOGNIZANCE OR SUPERVISED RELEASE INSTEAD OF MONEY BAIL. IN ADDITION, AFSC FAVORS DOING AWAY WITH 'PREVENTIVE DETENTION' AND DETENTION IN LIEU OF BAIL. OTHER RECOMMENDATIONS RELATE TO INFORMATION TO HELP JUDGES IN MAKING PRETRIAL DECISIONS AND TO CERTAIN RIGHTS OF THE ACCUSED PERSON. THE TEST OF EACH OF THE 17 RECOMMENDATIONS IS PRESENTED ALONG WITH A BRIEF COMMENT ON EACH ONE.
