This document summarizes cases decided by the West Virginia Supreme Court of Appeals from December 1995 through July 1998.
Abstract
Cases that affect areas in which Public Defender Services has been authorized to provide services are indexed. These encompass criminal, juvenile, abuse and neglect, paternity, contempt, and mental hygiene matters. The cases are presented alphabetically under the topics with which they primarily deal. Cases under the "umbrella" topics are further subdivided alphabetically by issue; e.g., cases that deal with abuse and neglect are further subdivided under issues such as abandonment, children's testimony, foster parents, guardians ad litem, etc. For each case, the issues addressed by the court of original jurisdiction are summarized and the court's decision indicated. The issues brought before the West Virginia Supreme Court of Appeals are then presented, along with the Court's disposition of the case. The table of contents of the previous volumes of the West Virginia Criminal Law Digest are appended.
