AN ANALYSIS OF THE SPANISH LEGISLATION REGARDING THE USE OF WEEKEND ARREST AS A MEASURE INVOLVING INDIVIDUALS JUDGED TO BE SOCIALLY DANGEROUS.
Abstract
THIS ARTICLE CRITICALLY EXAMINES THE SPANISH LAW GOVERNING THE USE OF WEEKEND ARREST AND PRESENTS PROPOSALS FOR THE MORE EFFECTIVE USE OF THIS MEASURE. THE AUTHOR SPECIFICALLY COMPARES THE PROVISIONS AND FUNCTIONING OF THE BELGIAN LEGISLATION ON WEEKEND ARREST AND RECOMMENDS THAT SOME ASPECTS OF IT SHOULD BE INCORPORATED IN THE SPANISH LAW. HE CONTRASTS THE APPLICATION OF THE WEEKEND ARREST SENTENCE IN BELGIUM FOR CERTAIN OFFENSES (FRAUD, FORGERY, RECKLESS DRIVING, PUBLIC DRUNKENESS, AND DRUNK DRIVING) WITH ITS USE IN SPAIN AS A SECURITY MEASURE. HE STATES THAT IN SPAIN, WEEKEND ARREST SHOULD BE USED AS A PUNITIVE MEASURE APPLIED IN CASES WITH SHORT (ONE OR TWO MONTH) SENTENCES. HE ALSO PROPOSES THAT THE USE OF WEEKEND ARREST AS A SECURITY MEASURE BE BASED ON SUCH CONSIDERATIONS AS DANGEROUSNESS OF THE OFFENDER, AND RECOMMENDS THAT IT BE APPLIED ONLY IN CASES IN WHICH A CRIMINAL OFFENSE HAS BEEN COMMITTED. --IN SPANISH
