AN ANALYSIS AND EVALUATION OF THE PROVISIONS OF SEVERAL INTERNATIONAL CONVENTIONS ON HIJACKING, WITH AN ATTEMPT TO DETERMINE THEIR EFFICACY AS PREVENTIVE AND PUNITIVE MEASURES.
Abstract
TO COUNTERACT THE MENACE OF HIJACKINGS, SABOTAGE, AND DESTRUCTION OF AIRCRAFT AND NAVIGATION FACILITIES, CERTAIN INTERNATIONAL CONVENTIONS HAVE BEEN ENTERED INTO AND SOME OTHER PROPOSALS MADE. SPECIAL CHARACTERISTICS OF THESE OFFENSES, CONTROVERSIAL QUESTIONS OF DEFINITION AND SCOPE, JURISDICTION, EXTRADITION, AND THE POLITICAL CHARACTER OF THE OFFENSES ARE DISCUSSED. LEGAL ISSUES ARISING OUT OF HIJACKING AND DESTRUCTION OF AN INDIAN AIRLINES PLANE IN PAKISTAN AND THE CONSEQUENT SUSPENSION OF FLIGHTS OF PAKISTANI PLANES OVER INDIAN TERRITORY HAVE ALSO BEEN ANALYSED. THE QUESTION OF APPLICATION OF SANCTIONS AGAINST STATES FOR FAILURE TO OBSERVE LEGAL OBLIGATIONS UNDER THESE CONVENTIONS IS STUDIED AS WELL.
