Abstract
THE AMENDMENTS TO THE FEDERAL RULES OF CRIMINAL PROCEDURE REPRESENTS A SIGNIFICANT STEP IN THE EXPANSION OF DISCOVERY FOR BOTH THE PROSECUTION AND THE DEFENSE. GIVEN THE INITIAL ADVANTAGE OF THE GOVERNMENT IN OBTAINING EVIDENCE FOR TRIAL, A NEARLY EQUAL INCREASE IN DISCLOSURE FOR BOTH SIDES LEAVES THE PARTIES IN THE SAME RELATIVE IMBALANCE AS PRIOR TO THE AMENDED RULES.
