PROBLEMS CONNECTED WITH AUTOMATION OF JUVENILE RECORDS SUCH AS THEIR CONFIDENTIALITY, AND A REVIEW OF LAWS PERTAINING TO JUVENILE RECORDS, AND SUGGESTIONS FOR NEEDED AREAS OF REGULATION.
Abstract
SIGNIFICANT FACTORS AGAINST INSTITUTING INFORMATION SYSTEMS DEALING WITH JUVENILE RECORDS ARE REVIEWED. THEY INCLUDE THE NEED TO PRESERVE THE CONFIDENTIALITY OF THESE RECORDS AND THE SOCIAL WELFARE ASPECT OF THE JUVENILE SYSTEM, WHICH PROVIDES INFORMATION DIFFICULT TO COMPUTERIZE. EXISTING STATE LEGISLATION CONCERNING JUVENILE RECORDS IS DISCUSSED. IN GENERAL, THERE ARE NO DEFINITIONS OF WHAT INFORMATION CAN BE COLLECTED AND UTILIZED, NO CONTROLS ON HOW IT IS GATHERED, NO LAWS CONCERNING THE JUVENILE'S RIGHT TO PRIVACY, AND NO LAWS CONCERNING USE OF COMPUTERS IN JUVENILE COURTS. LAWS IN VARIOUS STATES WHICH DO REGULATE CONFIDENTIALITY OF AND ACCESS TO JUVENILE RECORDS ARE EXAMINED. SUGGESTED REGULATIONS ARE LISTED TO FURTHER PROTECT JUVENILE RECORDS AND RECENT CASES ON MAINTENANCE OF ARREST RECORDS ARE REVIEWED.
