RESULTS OF A SURVEY OF FEDERAL AND STATE COURTS ON THE USE OF LAW CLERKS TO AID TRIAL AND APPELLATE JUDGES.
Abstract
THIS STUDY CONSISTS OF A COMPILATION OF THE NUMBER, QUALIFICATIONS, METHOD OF SELECTION, TERM OF OFFICE AND SALARIES OF LAW CLERKS EMPLOYED BY JUSTICES AND JUDGES OF THE UNITED STATES COURTS AND THE APPELLATE COURTS OF THE SEVERAL STATES. AT PRESENT, THERE IS AT LEAST ONE LAW CLERK PER JUDGE IN THE HIGHEST COURTS IN ALL BUT SIX STATES AND IN THE INTERMEDIATE APPELLATE COURTS IN ALL BUT THREE STATES. EVERY OTHER JURISDICTION INCLUDED IN THIS STUDY HIRES AT LEAST ONE LAW CLERK PER JUDGE, AND MANY HIRE MORE. THE CALIFORNIA SUPREME COURT HAS THE HIGHEST RATIO WITH 31 LAW CLERKS FOR SEVEN JUSTICES.
