IMPROVEMENTS IN THE LEGAL TRAINING OF THE GERMAN FEDERAL REPUBLIC'S POLICE OFFICERS ARE PROPOSED TO BRING THEORY AND PRACTICE AS WELL AS FEDERAL AND STATE TRAINING INTO CONFORMANCE.
Abstract
IT IS ASSUMED THAT A TRILEVEL CAREER PLAN, UNIFORM TRAINING FOR PROTECTIVE AND CRIMINAL POLICE, AND A 4-LEVEL TRAINING PROGRAM WILL BE MAINTAINED. LEGAL TRAINING MUST BE INTEGRATED INTO THE TOTAL TRAINING PROGRAM AND SHOULD CONSIST OF CONCRETE PRACTICAL CASES RATHER THAN THEORETICAL CONTROVERSIES, SO THAT THE POLICE OFFICER CAN APPLY LEGAL CONCEPTS AND RECOGNIZE THEIR FREQUENT CONFLICTS WITH PRACTICE. THE TRAINING IS DESIGNED FOR POLICE OFFICERS WHO ALREADY HAVE SOME PRACTICAL EXPERIENCE SO THAT THEY WILL NOT BE LEARNING JUST FOR THE SAKE OF THE POLICE EXAMINATION AT THE END OF THE FIRST TRAINING PHASE: WHILE CERTAIN TYPES OF LAW, E.G., INTERVENTION LAW, ARE ESSENTIAL EVEN IN THE INITIAL TRAINING PHASES, EFFICIENT POLICE WORK AT THE ADVANCED LEVELS REQUIRES REASONABLY THOROUGH KNOWLEDGE OF ADMINISTRATIVE, CIVIL, AND DISCIPLINARY LAW, AS WELL AS LAW RELATING TO OFFICIALS AND TO DEMONSTRATIONS. BECAUSE OF SHORTENED TRAINING PERIODS AND CONSTANT REVISIONS OF LAWS, CONTINUING AND SPECIALIZED EDUCATION COURSES TAUGHT BY EXPERIENCED OFFICERS MUST BE INTRODUCED. CERTAIN SEGMENTS WITHIN THE VARIOUS AREAS OF LAW ARE IMPORTANT TO LAW ENFORCEMENT; E.G., RECOGNITION OF POSSIBLE DANGERS UNDER POLICE AND ADMINISTRATIVE LAW, KNOWLEDGE OF CRIMINAL RATHER THAN GENERAL TRAFFIC VIOLATIONS IN TRAFFIC LAW, AND KNOWLEDGE OF THE LAWS OF ASSEMBLY. FINALLY, IT IS RECOMMENDED THAT LEGALLY TRAINED POLICE OFFICERS RATHER THAN LAWYERS BE SELECTED AS LAW INSTRUCTORS FOR POLICE TRAINEES AND THAT INDIVIDUALS ENTERING THE POLICE PROFESSION AT ADVANCED LEVELS RECEIVE SPECIAL INTENSIVE TRAINING IN LEGAL MATTERS. --IN GERMAN.
