PROVISIONS AND OFFICIAL COMMENTS OF THE NCCD MODEL LAW WHICH HAS AS ITS MAJOR ASSUMPTION THE TREATMENT RATHER THAN THE PUNISHMENT OF OFFENDERS.
Abstract
THE UNIQUE FEATURES OF THE MODEL SENTENCING ACT ARE THE DIFFERENTIAL SENTENCE LENGTHS BASED ON A CLASSIFICATION OF DANGEROUS OR NONDANGEROUS OFFENDER RATHER THAN SEVERITY OF THE CRIME AND A TRIPARTATE SENTENCING STRUCTURE OF TERMS OF EITHER 5, 10 OR 30 YEARS. THIS SECOND EDITION DIFFERS FROM THE FIRST IN THAT THERE IS GREATER PRECISION IN PROCEDURE AND SUBSTANTIVE DEFINITIONS AND THERE IS A NEW SECTION ON CRIMINAL RESPONSIBILITY.
