THE SECOND IN A SERIES OF THREE ARTICLES ANALYZING NEW JERSEY'S DEFENSE OF MENTAL IRRESPONSIBILITY, THIS ARTICLE EXAMINES THE PROPOSED STATUTE OF THE TEST OF CRIMINAL RESPONSIBILITY.
Abstract
THE FIRST ARTICLE IN THIS SERIES DISCUSSED THE TRADITIONAL M'NAGHTEN TEST OF LEGAL SANITY AS APPLIED IN NEW JERSEY AND MANY OTHER STATES. IN THIS ARTICLE, THE FORMULATION PROPOSED BY THE NEW JERSEY CRIMINAL LAW REVISION COMMISSION TO REPLACE M'NAGHTEN IS ANALYZED IN TERMS OF BOTH THE TRADITIONAL M'NAGHTEN TEST AND SIMILAR REFORMS IN EFFECT IN OTHER STATES.
